Finding legal support for property transactions

Most people in the UK don’t have a law firm on hand to resolve legal issues when they arise. Lawyers are normally consulted for a number of family matters including will writing, power of attorney and probate issues. However, a survey conducted in 2021 shows that conveyancing is the most accessed legal service in the country. The results published by Statista Research earlier this year showed that 28% of respondents had used conveyancing services.

Using a “common sense” attitude to selecting a solicitor to handle the legal work for your transaction will be a good starting point. As with most things, you need to ensure that the solicitor’s expertise is appropriate for ensuring a smooth transaction for all parties.

If your family already uses a law firm for other reasons they may seem like the natural first choice. However, you will need to have a solicitor who is a specialist in property conveyancing rather than one that specialises in divorce or litigation.

If you are moving into an area it is wise to use a solicitor that knows the territory. They will have the advantage of having local knowledge about the area you intend living and buying into, which is invaluable for a proper understanding of local development and planning policies as well as transport issues. The former is especially important should you intend to renovate, change or extend your home at a later date.

When making an offer on a property, It is a good idea to have a solicitor in place, awaiting your instructions or at the very least for you to know which solicitor you are going to ask to represent you. This will help make the process run as smoothly and efficiently as possible.

The selling agent will probably ask you for the name and contact details of your solicitor as soon as the selling price has been agreed. In a competitive market, agents and vendors will take buyers who are prepared more seriously and therefore having a solicitor lined up may give you an advantage even at the negotiation stage.
